Henry Howard and Elizabeth Moss

Henry Howard was born 16 October 1651 in Charles Parish, York Co., VA and died 22 December 1711 in York Co., VA. He was the son of John Howard and Margaret Clarke. He married 1st Dianah Bartlett, daughter of Michael and Mary Bartlett. She was also the sister of John Bartlett, who married Henry's sister Ellinor. She was born 18 Jul 1657 in Charles Parish, York Co, VA, and died 21 Apr 1699 in Charles Parish, York Co, VA He married next Elizabeth Moss daughter of Edward Moss. She died 26 Nov 1731 in Charles Parish, York Co, VA.

Charles Parish History and Registers, York County Virginia, Library of Virginia, Richmond Virginia (3rd Repring 1996) p. 9: "On reading this day in Council the Complaint of Henry Hayward, Senr., John Doswell and other Vestrymen of Charles Parish in York County against Thomas Nutting and others Vestrymen of the said Parish for opposing Mr. Thomas Cheesmans and Mr. Robert Shields voting in the said Vestry at the meeting appointed for advising of the repairing or building a Church. And upon hearing the allegations of both the said partys in Council this Board are of opinion that the present Constitution of the said Vestry is irregular and illegal. And for removing all differences that have or may arise in the said Parish by continuing the said Vestry It is ordered that a new vestry be fairly and legally elected and chosen by the Freeholders and householders of the said Parish...." p. 13: "The petition by Henry Howard, Edward Tabb, and others complained of an "undue and irregular election of a vestry for Charles parish on the 29th of June last past", because "votes of the parishioners were taken at their own houses twelve days before the day of the said Election and two days before publication of the order," and because of "diverse other irregularitys." p. 15: "The Council on February 18, 1708, took the case under consideration, and found "that the said election (of November 2, 1708) was fairly and regularly made according to Law, and the directions of this Board, and that it doth appear by the Return that Eleven of the said Vestrymen were chosen by a great Majority of the Inhabitants and it appearing also that there are two others returned who had an equal number of votes, It is the opinion of the Council that the Sherif amend his return by strikeing out one of them to make the number of the Vestry twelve and the return being amended accordingly. It was ordered that Henry Howard, Thomas Nutting, Thomas Chisman, Thomas Roberts, Robert Curtis, Henry Howard junior, Simon Stacy, Edward Tabb, and Anthony Robinson being duly Elected as aforesaid be sworn of a Vestry and that a Dedimus issue for that purpose directed to Robert Read and Wm. Buckner Gent or any one of them to administer to the said Vestrymen the Oaths and Test prescribed by Law for qualifying them for the said Offices."

In the name of God amen, the last Will & Testament of Henry Hayward of ye Parish of Charles in the County of York made on the 4th day of November in the year of our Lord 1811. I & unprofitable servant of God being strong and sound of mind & memory do willingly & with a free heart render & given again into the hands of my Lord God & Creator my spirit which he of the fatherly goodness gave unto me, when first he fashioned me in my mothers womb, making me a living and reasonable creature, nothing doubting but that for his infinite mercies sett forth in his precious blood of his dearly beloved son Jesus Christ my only Savior & Redeemer he will receive my soul into his Glory & grace in the company of heavenly angels & blesses saints. and as concerning my body even with a good will & free heart I give it over consigning it to the earth, whereof it came nothing doubting but that according to the articles of my faith at the great day of the great resurrection when I shall appear before the judgment seat of Christ I shall receive the same again by the mighty power of God, wherewith he is able to produce all things to himself, not a corruptible mortal, weak & vile body, as it is now, but an incorruptible immortal strong & perfect body in all points like unto the Glorious body of my Lord & Savior Jesus Christ. and as to my worldly estate which it hath pleased God to endow me with all I give & bequeath in manner & form following Viz. And it is my will & I do hereby leave & ordain five negroes by name peter, Jack, Tom, Black Betty & Nanny for to work to maintain my wife & children, besides the profitt of my estates that I have left them as above but if it should happen my should marry before my son Francis Hayward come to age & if man that she marrieth should be unkind unto my children my will is that my son Henry Hayward, Jn Moss & Wm Moss, Ben Moss shall have the care & trust of my children & their estates until my son Francis Hayward shall come of age of one & twenty years. And then it is my Will & desire that my son Francis shall have the care & trust of the rest of my children & their estates until they attain to the age as above. item my Will & mind is that I do hereby give & bequeath unto my said wife Eliza Hayward & to my said children Francis Hayward, Wm Hayward, Eliza Hayward & Jno Hayward, Anne Hayward all my Estate to be equally divided between them. Item all of my personall estate whatsoever & whereforever not here before bequeathed I give, devise & bequeath to be equally divided between my loving wife Eliza Hayward & my children Margaret Tabb, Elinor Chisman, Francis Hayward, Wm Hayward, Eliza Hayward, Jno Hayward and Anne Hayward, share & share alike. And I do hereby make, constitute, ordain & appoint my loving wife Eliza Hayward & my son Henry Hayward joint executors of this my last Will & Testament revoking all former Wills by me heretofore made, I do ordain this to be my last Will & Testament. In Witness whereof I have to this my said last will and Testament contained in Two sheets of paper affixed together set my hand & seal this day & year first above written. Signed: Henry Hayward. I've been researching this family recently. I agree with most of what you have said. However, I believe that William Hayward (2nd generation), son of John and Margaret Hayward, died in 1711 or 1712, not in 1719. In the Charles Parish Register of deaths, there are two William Haywards listed; one is said to have died on 27 Oct 1711, and the other on 5 Dec 1719. There is no further info in the Register about which William Hayward these two are. However, in York County, Virginia Deeds, Orders, Wills, Etc. 1711-1714, there is a court record from 15 Dec 1712 that says "Mary Hayward came into court and made oath that William Hayward departed this life without making any will so farr (sic) as she knows or believes, and having altogether with Simon Stacy and Henry Heyward, her securitys, presented...their bond for the said Mary's true and faithfull administration of the said decedent's estate..."(p. 206) (See also pp. 211, 217, 222-the inventory and appraisement.)

Also, York County, Virginia Deeds, Orders, Wills, Etc. 1718-1720 has a court record dated 15 Jun 1719 that says "on the petition of Margaret Hayward for her part of the estate of William Hayward her father late of this county dec'd, Robert Shield who intermarryed with the widow of sd. William appearing, by consent the petition is referred till next court for the said Robert to bring in and account and settlement of that estate." (p. 442) So clearly her father had died before Dec 1719. I believe the William Hayward who died Dec 1719 was the son of Henry and Elizabeth Hayward. He had been born in 1702 and presumably died single and without children.

The Margaret Hayward mentioned above was born 21 Sep 1690. She married Edward Worley (his second wife), and they had one son, Hayward Worley, born 9 May 1720. She died 1 Dec 1721. In his will dated 6 Apr 1724 and probated 20 Jul 1724, Edward Worley appointed "my loving Brother[in-law] William Hayward my whole executor of this my last will and testament..." Edward left his four young sons (three by his first wife Mary Clark) in the care of his brother-in-law William Hayward (the son of the William Hayward who died in 1711 or 1712).

I have been researching the link between Henry and his son William by Elizabeth Moss. There seems to be universal agreement regarding William's birth (1702), but not his death. Most sources have registered his death in 1751 and the father of a number of children. This would be impossible if he actually died in 1719 as provided herein.

William Howard/Heyward born 2 Feb 1658 in Charles Parish, York County, Virginia and died on 16 Dec 1719 in York County, Virginia married Mary Groves/Graves. I believe that this William's death date [approx]is the date recorded for William born 1702, which clears up the issue above.
